I was just reading a topic and suddenly it bitten my heart. An innocent girl was asking her mother while she was in hospital bed , mom why I am raped? What is my fault? The victims mother was weeping. What reply she will give her daughter? This not a case in the society. There are a lot of cases which no one knows. Many of them are not coming in front of media due to social prestige. I looked my beloved teen age daughter named Maliha and I could not keep my tears due to the heart bitten. At the moment I recall a Hadith from Prophet (pbuh) which happened in barbarian(jahelliya) age. A man was seating with Prophet(pbuh) and submitting his will by reciting shahada keeping his hand on Prophet’s(pbuh) hand. Suddenly he removed his hand and asking Prophet(pbuh), by shahada , do all my past sins will remove? Prophet(pbuh) replied yes. Then he was telling his own story how he killed his 5 years daughter. In the ignorance (jahellia) age it was their culture to burry the live daughters. So he was telling” just I came from my travel after long time. I have seen a beautiful girl at my home. I was happy. But in a certain time the ignorance attitude started to play in my brain. I told my wife dress herself well I will take her away for enjoyment. I was taking her in the desert. When I reached the place , was digging a hole. Dust are coming in my body and my daughter are removing from my body. Suddenly I have pushed her inside the hole and thrown a big stone on her chest. She was crying loudly , father don’t kill me I will not make any harm to you”. By hearing this Prophet(pbuh) is weeping and his beard was watering from his tears. Sura AT TAKBIR verse 8 “ A live buried girl will be questioned why she is killed?” Prophet(pbuh) amended the society by hard labor with his dedicated companion and spread the light of Quran within 23 years. Within ninety years , islam reached from Morocco to Indonesia. Prophet(pbuh) gave a new life in place of ignorance. In the ignorance age “Hind” the wife of Abu sufian and mother of Muaya’yia ® was asked about adultery. She replied those women are in freedom can they do this? At that time there were two kinds of people in the society. The people were in free life and the others are slave under them. In ignorance age also they were hating these type of adultery. In this age, we are telling this is a civilized society and you all are seeing adultery and rape are full to the brim in all over the world. It is not new and are happening everyday in many countries , many societies. The rulers are giving speech in the media, writers are writing column, society leaders are making possessions in the road etc. Even the case is happening decade after decade there is no proper prevention has taken by any of the rullers. All of us in the society should feel the impact of this subject clearly and initiative needs to be taken to ruin this subject from every society as well as from every country. We have to look these kind of social crisis as a real humanity in the caste creed and color. Allah swt. has sent human being as a best creature in this universe. We may muslim , Christian , Jew , Buddist or hindu. We may have different opinion according to the understanding of religion. We need to consider each other as human being as a well wisher and living peacefully in the society. It is very simple to realize each other. If I see an old lady, I have to respect her as my mother. If a young lady, I have to respect her as my wife. If a young girl I have to think as my daughter. The root causes of this , we have no respect and our thinking is wrong. We are diverting our thinking from good to evil. If all the people are following accordingly, rape or any other crime cannot be existed , no extremist or terrorist will born in the society. The rullers need to play a vital role for upgrading their attitude for the welfare of the society national and internationally.

Rape is a type of sexual assault usually involving sexual intercourse, which is initiated by one or more persons against another person without that person's consent. The act may be carried out by physical force, coercion, abuse of authority or with a person who is incapable of valid consent, such as one who is unconscious, incapacitated, or below the legal age of consent. The term is most often defined in criminal law.

Incest and rape are not new in this day and age. These problems have always existed and will continue to exist if not confronted face on. If you have ever worked with an incest, sexual abuse or rape survivor you will never be able to forget the devastating impact it has on all aspects of their life, nor will you be able to sit back and do nothing about this issue. These are serious crimes that corrode the fabric of family and society and cannot go un-addressed, since these problems do exist in Muslim families it is about time that we address it openly and take action to put an end to it.

To fully understand this issue we need to examine what Islâm teaches us about the value of human life.Islâm views human life as a sacred gift from Allah swt. The Qur’ân repeatedly stresses the sanctity of life (hurmat al hayat). The life of every single individual regardless of gender, age, nationality or religion is worthy of respect. In verses referring to the sanctity of life, the term used is ‘nafs’ (soul, life) and there is no distinction made in that soul being young or old, male or female, Muslim or non-muslim.

Sûrah al An'am verse 151 explained :"Do not take any human being's life, (the life) which Allah has declared to be sacred - otherwise than in (the pursuit of) justice: this has He enjoined upon you so that you might use your reason." Sura Isra verse 33 explained “"Do not approach (the bounds of) adultery" Sura mai’da verse 32 also explained “ the one is killed a person , he killed whole nation and the one gave life a person , he gave the life of whole nation.”

Qur’ânic teachings encompass every aspect of life. Hence it does not limit the definition of life to the physical body only, but includes the mental, emotional and spiritual aspects as well. There are about 150 verses that define the term ‘nafs’ in various ways making it clear that the concept of ‘life’ is not limited to mere physical existence.

Historically, Islam has addressed serious issues openly and sought to correct actions that constitute harm or ‘zulm’ ( cruelty and abuse) to the dignity of humankind. Human life and respect for it has been stressed unstintingly, regardless of age or gender. As a general rule, Islâm forbids all ‘zulm’, be it physical, mental, emotional or spiritual:

Sûrah al An'am verse 120 explained ”Abandon all harm (ithm), whether committed openly or in secret.” Sûrah al A`raf verse 33 explained “ Surely my lord prohibited adultery”

Sûrah Hujrat verse 11 and 12 points out categorically that emotionally abusive language and behavior is not acceptable."You who believe do not let one (set of) people make fun of another set. Do not defame one another. Do not insult by using nicknames. And do not backbite or speak ill of one another."

In the last address to his community, the Prophet (pbuh) said: "Your lives and properties are forbidden to one another till you meet your Lord on the Day of Resurrection… Regard the life and property of every Muslim as a sacred trust… Hurt no one so that no one may hurt you... You will neither inflict nor suffer any inequity." The Prophet (pbuh) did not prohibit only the unlawful encroachment of one another’s life and property, but also honor and respect.

Considering that human life is to be valued and cruelty is forbidden, what is the Islamic perspective on incest and rape?

According to Islâm, a woman has to be respected and protected under all circumstances, whether she belongs to your own nation or to the nation of an enemy, whether she follows your religion or belongs to some other religion or has no religion at all. A Muslim cannot outrage her under any circumstances. All promiscuous relationships have been forbidden to him, irrespective of the status or position of the woman, whether the woman is a willing or an unwilling partner to the act. The words of the Holy Qur’ân sura Isra verse 32 explained in this respect are: "Do not approach (the bounds of) adultery" . Heavy punishment has been prescribed for this crime, and the order has not been qualified by any conditions. Since the violation of chastity of a woman is forbidden in Islam, a Muslim who perpetrates this crime cannot escape punishment.

The Quran has, in various ways and in different contexts; impressed on men that they must observe the limits set by Allah swt. (Hudûd of Allah) in respect to women and must not encroach upon their rights in either marriage or divorce. In all situations it is the men who are reminded, corrected and reprimanded, over and over again, to be generous to women and to be kind, compassionate, fair and just in their dealings with women. Even in divorce, when the chances of anger and vindictiveness are high, it is stressed that men are to separate with grace, equity and generosity.

Forbidding cruelty against children and women is apparent from rulings against female infanticide and rights of inheritance given even to an unborn child; and the kindness mandated even when divorcing your wife. There are numerous ahâdîth about the rights of children to respect and dignity. The same holds true for respect and the unprecedented rights given to women. Relevant verses from the Quran sura An Nisa verse 119 explained “O you who believe! You are forbidden to inherit women against their will...'’ Sura an Nur verse 33 explained

'... And do not, in order to gain some of the fleeting pleasures of this worldly life, coerce your slave women into whoredom if they are desirous of marriage, and if anyone should coerce them, then, verily, after they have been compelled (to submit in their helplessness), God will be much forgiving, a dispenser of grace (to them).

During the time of the Prophet (saw) punishment was inflicted on the rapist on the solitary evidence of the woman who was raped by him. Wa'il ibn Hujr reports of an incident when a woman was raped. Later, when some people came by, she identified and accused the man of raping her. They seized him and brought him to Allah's messenger, who said to the woman, "Go away, for Allâh has forgiven you," but of the man who had raped her, he said, "Stone him to death." (Tirmidhi and Abu Dawud)

During the time when Umar (raa) was the Khalifah, a woman accused his son Abu Shahmah of raping her; she brought the infant borne of this incident with her to the mosque and publicly spoke about what had happened. Umar (raa) asked his son who acknowledged committing the crime and was duly punished right there and then. There was no punishment given to the woman.

Islamic legal scholars interpret rape as a crime in the category of Hiraba. In ‘Fiqh-us-Sunnah’, hiraba is described as: ‘a single person or group of people causing public disruption, killing, forcibly taking property or money, attacking or raping women (hatk al ‘arad), killing cattle, or disrupting agriculture.’

The famous jurist, Ibn Hazm, had the widest definition of hiraba, defining a hiraba offender as: ‘One who puts people in fear on the road, whether or not with a weapon, at night or day, in urban areas or in open spaces, in the palace of a caliph or a mosque, with or without accomplices, in the desert or in the village, in a large or small city, with one or more people… making people fear that they’ll be killed, or have money taken, or be raped (hatk al ‘arad)… whether the attackers are one or many."

The crime of rape is classified not as a subcategory of ‘zina’ (consensual adultery), but rather as a separate crime of violence under hiraba. This classification is logical, as the "taking" is of the victim’s property (the rape victim’s sexual autonomy) by force. According to Ghazali “In Islam, sexual autonomy and pleasure is a fundamental right for both women and men “ Taking by force someone’s right to control the sexual activity of one’s body is thus a form of hiraba.

Rape as hiraba is a violent crime that uses sexual intercourse as a weapon. The focus in a hiraba prosecution is the accused rapist and his intent and physical actions, and not second-guessing the consent of the rape victim. Hiraba does not require four witnesses to prove the offense, circumstantial evidence, medical data and expert testimony form the evidence used to prosecute such crimes.

Islamic legal responses to rape are not limited to a criminal prosecution for hiraba. Islamic jurisprudence also provides an avenue for civil redress for a rape survivor in its law of "jirah" (wounds). Islamic law designates ownership rights to each part of one’s body, and a right to corresponding compensation for any harm done unlawfully to any of those parts. Islamic law calls this the ‘law of jirah’ (wounds). Harm to a sexual organ, therefore, entitles the person harmed to appropriate financial compensation under classical Islamic jirah jurisprudence. Each school of Islamic law has held that where a woman is harmed through sexual intercourse (some include marital intercourse), she is entitled to financial compensation for the harm. Further, where this intercourse was without the consent of the woman, the perpetrator must pay the woman both the basic compensation for the harm, as well as an additional amount based on the ‘diyya’ (financial compensation for murder, akin to a wrongful death payment).

Islamic law, with its radical introduction of a woman’s right to own property as a fundamental right, employs a gender-egalitarian attitude in this area of jurisprudence. In fact, there is a hadith specifically directed to transforming the early Muslim population out of this patriarchal attitude of male financial compensation for female sexual activity. During the time of Prophet Muhammad (swt), a young man committed zina(adultery) with his employer’s wife. The father of the young man gave one hundred goats and a maid as compensation to the employer, who accepted it. When the case was reported to the Prophet, he ordered to return the goats and the maid to the young man’s father and prosecuted the adulterer for zina ( Sohi Bukhari and Abu Daud ).

Early Islam thus established that there should be no tolerance of the attitude that a woman’s sexual activity is something to be bartered, pawned, gossiped about, or owned by the men in her life. Personal responsibility of every human being for their own actions is a fundamental principle in Islamic thought.

Marital Rape, The Quran is very clear that the basis of a marital relationship is love and affection between the spouses, not power or control. Rape is unacceptable in such a relationship. Sûrah al Baqarah verse 223 explained ”Your wives are your tilth; go then unto your tilth as you may desire, but first provide something for your souls, and remain conscious of Allah, and know that your are destined to meet Him...”

Sûrah ar Rum verse 21 explained"And among His wonders is this: He creates for you mates out of your own kind, so that your might incline towards then, and He engenders love and tenderness between you: in this, behold, there are messages indeed for people who think!” Sûrah al Baqarah verse 187 explained "... They are as a garment for you, and you are as a garment for them." Sûrah al Nisa verse 19 explained

"... And consort with your wives in a goodly manner, for if you dislike them, it may well be that you dislike something which Allah might yet make a source of abundant good."

Is there recognition of marital rape in Islam?

In the context of jirah(wounds), it would appear so: where there is any physical harm or disease caused to a spouse, there may be a claim for jirah(wounds) compensation. The law of jirah(wounds) provides for compensation for physical harm between spouses, and supports Islamic legislation against domestic abuse. Even in these discussions of appropriate jirah(wounds) compensation, the question of the injured party’s consent plays a central role. Some Islamic jurists considered consent to be presumed by virtue of the marital relationship, while others maintain that where harm occurs, it is an assault, regardless of the consent, and therefore compensation is due. In our modern era, one might take these precedents and their premium focus on consent and apply the Islamic principle of sexual autonomy to conclude that any sex without consent is harmful, as a dishonoring of the unwilling party’s sexual autonomy. Thus, modern Islamic jurists and legislators, taking a gender-egalitarian perspective, might conclude that Islamic law does recognize marital rape, and assign the appropriate injunctions and compensation for this personally devastating harm.

An often misquoted and abused hadith that is used to tyrannize women is that women cannot and should not say no to their husband when he approaches them Women are advised not to turn away from their husbands except if they have their period or any other reasonable excuse. So much so that she is to break her voluntary fast if her husband approaches her. And if they do angels will curse them. However, this hadith is not quoted with the complementary one that advises men of the same consideration.

In the same manner men are advised that meeting the needs of their wives takes precedence over voluntary worship. Narrated Abdullah bin Amr bin Al-As: "Prophet Muhammad (saw) said, “O Abdullah! I have been informed that you fast all the day and stand in prayer all night?” I said, ‘Yes, O Allah's Apostle!’ He said, “Do not do that! Observe the fast sometimes and also leave them at other times, stand up for the prayer at night and also sleep at night. Your body has a right over you and your wife has a right over you.” (Bukhâri)

To a certain degree these ahâdîth are used to confuse and distract from the issue, since rape does not have anything to do with permission or lack of permission. In a marriage abusive or forced sexual activity cannot be justified by abusing this hadith. Rape is defined as unwanted, violent and forced sex, whether this occurs in a marital context or outside it. The definition of rape does not change because of the relationship.

It is important not to confuse the issue of mutual rights that a couple has on each other with the misguided, distorted and misogynist assumption that women become a husband's property. Islam does not allow for or tolerate ownership of human beings. Human dignity does not allow that any one person has the right to own, mind/body/soul, another human being... and Islam demands that all human beings respect the humanity of everyone.

Incest & Child AbuseThe Quran clearly outlines those with whom marriage is not permitted, we can extrapolate from it that any sexual relation with these would be unacceptable.Sûrah an Nisa verse 23 explained “ Prohibited for you (in marriage) are your mothers, your daughters, your sisters, the sisters of your fathers, the sisters of your mothers, the daughters of your brother, the daughters of your sister, your nursing mothers, the girls who nursed from the same woman as you, the mothers of your wives, the daughters of your wives with whom you have consummated the marriage - if the marriage has not been consummated, you may marry the daughter. Also prohibited for you are the women who were married to your genetic sons. Also, you shall not be married to two sisters at the same time - but do not break up existing marriages. Allah is Forgiver, Most Merciful.”

This includes your foster parents, siblings and children.Al Hasan reports: ‘If somebody commits illegal intercourse with his sister, his punishment is the same as for any other person who commits such a crime’. (Bukhâri )

Thus, these same laws mentioned above in cases of rape would be equally applicable, and incest can be prosecuted as a crime within the bounds of Islamic law.

According to Islam, all aspects of life, the physical, mental, emotional and spiritual, are sacred and must be respected. No gender or relationship has been given the power or right to hurt or harm the other. Domestic violence, rape and incest are all violent and criminal abuses that are outside the bounds of what is permitted in Islam and there is absolutely no justification for it whatsoever.

In Islam, we follow the laws of the Noble Quran, and the Sayings of Prophet Muhammad peace be upon him. If a situation or case is not addressed in neither the Noble Quran, or the Sayings of our beloved Prophet, then we follow the local verdicts of our Religious Authorities, where they would decide based upon the cultural and social situation and causes.

Allah swt. said in the holy Quran Sura Nisa verse 59 :"O ye who believe! Obey God, and obey the Apostle, and those charged with authority among you. If ye differ in anything among yourselves, refer it to God and His Apostle, if ye do believe in God and the Last Day: That is best, and most suitable for final determination". Sura Al Imran verse 164 explained"Allah did confer a great favour on the believers when He sent among them an apostle from among themselves, rehearsing unto them the Signs of God, sanctifying them, and instructing them in Scripture and Wisdom, while, before that, they had been in manifest error. “ Sura Ma’ida verse 92 explained “Obey God, and obey the Apostle, and beware (of evil): if ye do turn back, know ye that it is Our Apostle's duty to proclaim (the message) in the clearest manner." Sura Al Nahl verse 44 explained "(We sent) clear proofs and the scriptures. Now, We have sent you this reminder (Qur’an) so that you may demonstrate the revelations to them. Perhaps they may reflect and ponder!" Sura Nisa verse 83 explained "When there comes to them some matter touching (Public) safety or fear, they divulge it. If they had only referred it to the Apostle, or to those charged with authority among them, the proper investigators would have Tested it from them (direct). Were it not for the Grace and Mercy of God unto you, all but a few of you would have fallen into the clutches of Satan. " Sura A’raf verse 157 explained "Those who follow the apostle, the unlettered Prophet, whom they find mentioned in their own (scriptures), in the law and the Gospel for he commands them what is just and forbids them what is evil; he allows them as lawful what is good (and pure) and prohibits them from what is bad (and impure); He releases them from their heavy burdens and from the yokes that are upon them. So it is those who believe in him, honour him, help him, and follow the light which is sent down with him, it is they who will prosper".Sura An Nur verse 54 and 56 explained "Say: "Obey God, and obey the Apostle, but if ye turn away, he is only responsible for the duty placed on him and ye for that placed on you. If ye obey him, ye shall be on right guidance. The Apostle's duty is only to preach the clear (Message)." And "So establish regular Prayer and give regular Charity; and obey the Apostle; that ye may receive mercy." Sura Ahzab verse 21 ,36 and 66 explained "Ye have indeed in the Apostle of God a beautiful pattern (of conduct) for any one whose hope is in God and the Final Day, and who engages much in the Praise of God." "It is not fitting for a Believer, man or woman, when a matter has been decided by God and His Apostle to have any option about their decision: if any one disobeys God and His Apostle, he is indeed on a clearly wrong Path." "The Day that their faces will be turned upside down in the Fire, they will say: "Woe to us! Would that we had obeyed God and obeyed the Apostle!" Sura Jumuah 62 explained "It is He Who has sent amongst the Unlettered an apostle from among themselves, to rehearse to them His Signs, to sanctify them, and to instruct them in Scripture and Wisdom,- although they had been, before, in manifest error". Sura Tagabun verse 12 explained "So obey God, and obey His Apostle: but if ye turn back, the duty of Our Apostle is but to proclaim (the Message) clearly and openly".

Since the punishment for rape doesn't exist in the Noble Quran, but exists in the Sayings of our beloved Prophet peace be upon him, then the verdict or law for punishing the rapist according to Noble Verses Sura Nisa verse 59 and 83 above must come from our beloved Prophet's Sayings.Let us look at what Prophet Muhammad peace be upon him said regarding this issue:

Prophet Muhammad (pbuh) dealt with the rapists :Narrated Wa'ilibn Hujr:"When a woman went out in the time of the Prophet (pbuh) for prayer, a man attacked her and overpowered (raped) her. She shouted and he went off, and when a man came by, she said: That (man) did such and such to me. And when a company of the Emigrants came by, she said: That man did such and such to me. They went and seized the man whom they thought had had intercourse with her and brought him to her. She said: Yes, this is he. Then they brought him to the Apostle of Allah (swt). When the Prophet(pbuh) was about to pass sentence, the man who (actually) had assaulted her stood up and said: Apostle of Allah, I am the man who did it to her.The Prophet(pbuh) said to the woman: Go away, for Allah has forgiven you. And about the man who had intercourse with her, The Prophet(pbuh) said, Stone him to death. The Prophet(pbuh) also said, He has repented to such an extent that if the people of Medina had repented similarly, it would have been accepted from them. (Sunan Abu Dawud)"

Picture of Bangladesh

Atrocities against Bengali women during the war 1971 as was also the case in Armenia and Nanjing, Bengali women were targeted for gender-selective atrocities and abuses, notably gang sexual assault and rape/murder, from the earliest days of the Pakistani genocide. Indeed, despite (and in part because of) the overwhelming targeting of males for mass murder, it is for the systematic brutalization of women that the "Rape of Bangladesh" is best known to western observers.

In her ground-breaking book, Against Our Will: Men, Women and Rape, Susan Brownmiller likened the 1971 events in Bangladesh to the Japanese rapes in Nanjing and German rapes in Russia during World War II. "... 200,000, 300,000 or possibly 400,000 women (three sets of statistics have been variously quoted) were raped. Eighty percent of the raped women were Moslems, reflecting the population of Bangladesh, but Hindu and Christian women were not exempt. ... Hit-and-run rape of large numbers of Bengali women was brutally simple in terms of logistics as the Pakistani regulars swept through and occupied the tiny, populous land ..." (p. 81).

Typical was the description offered by reporter Aubrey Menen of one such assault, which targeted a recently-married woman:

Two (Pakistani soldiers) went into the room that had been built for the bridal couple. The others stayed behind with the family, one of them covering them with his gun. They heard a barked order, and the bridegroom's voice protesting. Then there was silence until the bride screamed. Then there was silence again, except for some muffled cries that soon subsided. In a few minutes one of the soldiers came out, his uniform in disarray. He grinned to his companions. Another soldier took his place in the extra room. And so on, until all the six had raped the belle of the village. Then all six left, hurriedly. The father found his daughter lying on the string cot unconscious and bleeding. Her husband was crouched on the floor, kneeling over his vomit. (Quoted in Brownmiller,Against Our Will, p. 82.)

"Rape in Bangladesh had hardly been restricted to beauty," Brownmiller writes. "Girls of eight and grandmothers of seventy-five had been sexually assaulted ... Pakistani soldiers had not only violated Bengali women on the spot; they abducted tens of hundreds and held them by force in their military barracks for nightly use." Some women may have been raped as many as eighty times in a night (Brownmiller, p. 83). How many died from this atrocious treatment, and how many more women were murdered as part of the generalized campaign of destruction and slaughter it’s an imagination.

Despite government efforts at amelioration, the torment and persecution of the survivors continued long after Bangladesh had won its independence:

Rape, abduction and forcible prostitution during the nine-month war proved to be only the first round of humiliation for the Bengali women. Prime Minister Mujibur Rahman's declaration that victims of rape were national heroines was the opening shot of an ill-starred campaign to reintegrate them into society -- by smoothing the way for a return to their husbands or by finding bridegrooms for the unmarried or widowed ones from among his Mukti Bahini freedom fighters. Imaginative in concept for a country in which female chastity and purdah isolation are cardinal principles, the "marry them off" campaign never got off the ground. Few prospective bridegrooms stepped forward, and those who did made it plain that they expected the government, as father figure, to present them with handsome dowries. (Brownmiller, Against Our Will, p. 84.)

A recent crime which happened for Hena Begum, a 14-year-old old Bangladeshi girl, was publicly flogged recently in Shariatpur, 35 miles outside of the capital, Dhaka after being accused of having an affair with her 40-year-old married cousin. According to the BBC, a village court made up of Islamic clerics and elders sentenced Begum to 100 lashes under Islamic Sharia law. The girl lost consciousness after 80 lashes and her family, who were also ordered to pay 50,000 taka (approximately $700), took her to the hospital where she died six days later.“What sort of justice is this?” Begums father told theBBC. “My daughter has been beaten to death in the name of justice. If it had been a proper court then my daughter would not have died.”As for the “affair” accusation, Bangladesh’s Daily Star suggests that Begum was actually raped by the cousin.Four people, including a Muslim cleric, have also been arrested in connection with Begum’s death and the police are looking for an additional 14 people who were involved. The country’s High Court has ordered officials in Shariatpur to explain why Begum was sentenced under Sharia law, since Sharia punishment was made illegal in October 2010. That’s when the High Court declaredBangladesh a secular state, making the issuing of fatwas illegal and a punishable offense.Begum’s death is a testament to how, despite efforts by Bangladeshi women’s rights groups and civil society, the legal system in the country remains inaccessible for the majority of the population. It often fails to protect those who need it the most: women and children. Longtime Bangladeshi women’s rights activist and former Member of Parliament, Tasmima Hossain, explained the situation to me:

The legal system in our country has failed to reach the ordinary masses. Neither the Government nor the NGOs or any legal system is physically or financially accessible to 90 percent of the people. They cannot afford it. So the primitive Sharia law takes advantage of that in the name of salish, or arbitrary rulings like we have seen in the case of Hena Begum. The so-called mullahs and local village leaders take advantage of the situation in the name of religion. The BBC reports that dozens of fatwas are issued under Sharia law each year by village clergy in Bangladesh, and this is the second death linked to Sharia punishment despite the practice being outlawed: In December, a 40-year-old woman died in the Rajshahi district after she was caned publicly for having an affair with her stepson. There are a lot of incidents and social crime are happening daily basis , those are un tolerable and un expressable. Some of the leaders of the country are raising their voice as “ country is raped”. Every country has her own intelligence agencies to ensure the peoples rights.

Recently all experts and thinkers are demoralized for the rape situation of Bangladesh. Last few months media and news papers were flushing many sensitive rape cases which is known by all. There are some reports also displayed in news papers. Human rights report 2012 expreseed in 2011 1149 female are victimized for rape cases. From this 263 were killed and 19 killed by the victim itself and 250 were suffered in physical assault. Bangladesh Mohila Porishad reported 5616 were raped in 2012. Within this 900 female and infant were killed. In the beginning of 2013 also many rape cases happened such as 11th January a girl of 4th standard raped in nilpamari , 13th January five years school student in Rajbari, 17th January 15 years teen ager in hobigonj etc. in this situation old ladies or young ladies or children no one is safe but from government no positive role is playing for these incidents. If anyone is affected in severe disease needs to find out the root cause for the disease and then proper treatment. Without determining causes if doctor is applying medicine patient can be died. So for these social diseases first of all needs to find out all root causes. There are some causes like , Free mix up of youth boy and girls, tight fit dresses for girls and ladies, Freedom of All satellite channels (internet , facebook, pornography), internal media’s displaying worst cinema, drama and other pornography, high power drinks used in family atmosphere, mass freedom in parks and amusement centers and prostitute are available in many hotel , motels. These are playing a vital role to increase rape in the society. So the government must take emergeny initiative to protect all these causes. There are some steps can be adopted for these type of social disease such as, stop to use tight fit dresses and import to be minimized, social good culture and Islamic culture to be excercised, all sorts of pornography to be stopped from the society ,rapist to be hanged by the amendment of rules, park and amusements are to be displayed educational activities and security to be increased by police force, Islamic basic education to be included in the syllabus, all campuses to be separated amusement for boys and girls, Bill board to be established by displaying raping punishment , (internet , mobile , facebook ) not to be given under adults and above all government force to increased for the society. If any government are instructing properly to the agencies insalalh this sort of disease will reduce and people must be educated for the same.

An intelligence agency is a government agency responsible for the collection, analysis or exploitation of information and intelligence in support of law enforcement, national security, defence and foreign policy objectives. Means of information gathering are both overt and covert and may includeespionage, communication interception, cryptanalysis, cooperation with other institutions, and evaluation of public sources. The assembly and propagation of this information is known as intelligence analysis or intelligence assessment.Intelligence agencies can provide the many services for their national governments as: Provision of analysis in areas relevant to national security;give early warning of impending crises; serve national and international crisis management by helping to discern the intentions of current or potential opponents;inform national defence planning and military operations; protect sensitive information secrets, both of their own sources and activities, and those of other state agencies; may act covertly to influence the outcome of events in favour of national interests, or influence international security; andDefence against the efforts of other national intelligence agencies (counter-intelligence).There is a distinction between "security intelligence" and "foreign intelligence". Security intelligence pertains to domestic threats (e.g. terrorism, espionage). Foreign intelligence involves information collection relating to the political, or economic activities of foreign states. Some agencies have been involved in assassination, arms trafficking, coups d'état, and the placement of misinformation (propaganda) as well as other covert operations, in order to support their own or their governments' interests. Bangladesh armed forces consists of the three uniformed military services as Bangladesh Army ,Navy and Air force. The para military Border Guard Bangladesh and Bangladesh Coast guard are under the jurisdiction of the Ministryof Home affairs during peace time but during wartime they fall under the command of Bangladesh Army and Navy respectively.

Interpol is the world’s largest international police organization with 188 member countries created in 1923. It facilitates cross border police co-operation and supports and assists all organizations, authorities and services whose mission is to prevent for combat international crime. Interpol aims to facilitate international police co-operation even where diplomatic relations do not exist between particular countries. Action is taken within the limits of existing laws in different countries and in the spirit of the Universal declaration of human rights. Interpol’s constitution prohibits any intervention or activities of a political , military , religious or racial character. Child exploitation on the internet ranges from posed photos to visual recording of brutal sexual crimes. Given the global reach of the internet, the posting of child abuse material online constitutes an international crime and demands concerted collaboration worldwide. Interpol provides a central point of contact for police around the world , enabling investigators to work more effectively on a local ,national and international level.

Even all the forces world wide, few actions are taken , crimes are going to be higher national and international level. Most of the countries law and enforcement are too weak and many places the forces are breaking the law and inclined with mal practices. Thousands of cases are accumulated in the court and victims are not getting proper justice due to political power , due to the bribe , due to the ancient official procedure. These are the social disease and it will never be reduced by human made law. Human made law can be amended time to time. When any dictator will be in power he will amend the legislation by his choice and it is happening most of the countries. The divine law is fixed which is in the sight of Allah swt. No one has right to touch it. Allah swt. described “ we descend the Quran and we will save it”.

Inspite of all these incidents, in conclusion we have to come in one point that is “ friendship to all no enmity with others”. In every country’s foreign policy agreeing the point. At least in muslim countries the disease(rape) should not be happen. We have to save our generation from these type of pathetic scenes which we are facing everyday. We have to love each other, help each other and have sympathy for any occurrence. If the brotherhood is increasing and we are working as one ummah in the society, insaallah not only this, all other problem will be solved and please go through the following verses how muslims are tieing themselves in brotherhood. It is perfectly natural for there to be different cultures, traditions and understandings in the Islamic world. The important thing is for these differences to be brought together within a unity of belief and pluralist solidarity. Differences of ideas, opinions and practice are regarded as normal in all societies. But Islamic moral values require that, despite all their differences, Muslims must not forget that they are brothers. No matter what their race, language, nation or sect, all Muslims are brothers. Therefore, differences within the Islamic world must be regarded as sources of wealth. They must not turn into causes of division and conflict that lead Muslims to fall out with one another, distract them from the main issues and prevent them from adopting urgent and essential measures. Believers constitute a great spiritual force with the strength that comes from loving one another for Allah’s approval. As revealed in Surat al-Baqara, verse249, "… But those who were sure that they were going to meet Allah said, ‘How many times a small force has triumphed over a much greater one by Allah’s permission! Allah is with the steadfast.”, even if those with faith in their hearts are few in number, spiritually, they acquire great will and enthusiasm with which to overcome great difficulties and obstacles. The love among Muslims is a naturally occurring love resulting from a faith-based sincerity. Is not based on any self-interest; believers love one another solely for Allah’s approval. This sincere love also brings with it a lofty conception of humility. And when love and humility are combined together, the result is a powerful bond among Muslims. The people to whom believers most direct their love as manifestations of Allah are their brothers in faith. As Allah says in Surat al-Hujurat verse 10, "The faithful are brothers..." ,Muslims are one anothers brothers. Therefore, as with blood brothers, the relationship between Muslims is based on a profound love, and they watch over and protect one another.Allah gives love to the heart of every Muslim who loves Him, fears Him and genuinely strives to seek His approval. Allah swt states that it is His Presence that creates love among believers: Surah Maryam, verse 96“As for those who have faith and do right actions, the All-Merciful will bestow His love on them.” Since these people love Allah, they will also love His creations and feel affection and compassion for them. They will wish to protect them and seek the best for them. As Allah tells believers, whom He has made his best and most virtuous servants: Surat ash-Shura, verse 23 “Say: ‘I do not ask you for any wage for this –except for you to love your near of kin. If anyone does a good action,We will increase the good of it for him. Allah is Ever-Forgiving, Ever-Thankful’.” Muslims Loving One Another, in this World Is a Moral Virtue of Paradise

It is incompatible with Qur’anic moral values for the bond of love that Muslims feel for one another to be limited to a small community. That bond of love must include all sects and communities and even the entire Islamic world. Allah disapproves of coldness, and even conflict, between sects and communities. All Muslims must hope to enter paradise and strive for that by doing good works. But in order to enter paradise they must love one another. In paradise, all Muslims are a single community, and verses reveal that Muslims will recognize one another there, talk with one another, be friends and love one another: Surat al-Waki’ah, verse 12-16 “in Gardens of Delight. A large group of the earlier people but few of the later ones.On sumptuous woven couches, reclining on them face to face.” Another verse reveals that brotherhood, profound love and devotion among Muslims is one of the features of paradise as follows. Surat al-Hijr, verse 47 "We will strip away any rancor in their hearts – brothers, resting on couches face-to-face.”

Muslims are a single community in paradise, and there are no communities or groups that do not love another, and everyone is equal. There is also an obligation for his model in paradise as described in the verses to be adopted and implemented in this world, too. Allah warns Muslims in another verse that they must be very considerate of one another and that there must be a bond of love between them, and He reveals that this will be pleasing to Him: Surat as-Saff, verse 4 “Allah loves those who fight in His Way in ranks like well-built walls.”

Surat al-Anbiya’, verse 92-93 “This nation of yours is one nation and I am your Lord, so worship Me. But they disagreed and split into different sects. Each one will return to Us. Hold fast to the rope of Allah all together, and do not separate.” Surah Al ‘Imran, verse 103 “Remember Allah’s blessing to you when you were enemies and He joined your hearts together so that you became brothers by His blessing. You were on the very brink of a pit of the Fire and He rescued you from it. In this way Allah makes His Signs clear to you, so that hopefully you will be guided.”

Surat al-Anfal, verse46 “Obey Allah and His Messenger and do not quarrel among yourselves lest you lose heart and your momentum disappear. And be steadfast. Allah is with the steadfast.

Allah commands all muslims to strive together as one in Surat an-Anfal, verse 39 “Struggle with them until there is no more corruption and the religion is Allah’s alone.” Muslime must strive together as one. There have been twelve months with Allah in the Book of Allah, from the day He first created the heavens and earth. Four of them are forbidden. That is the True Religion. So do not wrong one another during them. However, Surat at-Tawba, verse 36 “ Struggle with the idolators totally just as they struggle with you ttally. and know that Allah is with those who guard against evil.”

Muslims strive together under the leadership of imam as Surah Al ‘Imran: verse 121"Remember when you left your family early in the day to install the believers in their battle stations, Allah is All-Hearing, All-Knowing". Surah Al ’Imran, verse 146” many a prophet has been fought ,when there were many thousands with him. They did not give up in the face of what assailed them in the Way of Allah, nor did they weaken, nor did they yield. Allah loves the steadfast.” Surat at-Tawba, verse 41” go out to fight , light armed and heavy armed , and strive with your wealth and yourselves in the way of Allah. That is better for you if you only knew. Surat al-Anfal, verse 65-66” O prophet! Spur on the believers to fight. If there are twenty of you who are steadfast, they will overcome two hundred; and if there are a hundred of you, they will overcome a thousand of the unbelievers, because they do not understand.Prophet Mohammad (pbuh) said: “When you are three people, appoint one from amongst you as your leader. (Muslim, Nessai, Ahmad)

May Allah swt bless all of us help to understand each other as a body , as a mankind to face all the situation. Narrated from abu Huraira ,Prophet Mohammad (pbuh) said “ An adulterate when joined in adultery , he is no more a believer. A drunkard when started to drink, he is no more a believer. A thief when he started to steal something , he is no more a believer. A snatcher when snatching in front of others, he is no more a believer”.( Sohi Bukhari) A rapist also is not a believer. In the society few people are working for dawa illallah. We will be asked for our whole life , for our youth , for our earning and spending and for our knowledge we distributed or not. O brothers of islam! fear Allah swt as the way need to fear. One day we will meet with him and will be accountable to him for our action.
